This is a question we are asked quite often and it is certainly not easy to answer. Carrying out renovation work in a home is not the same as changing the television or any other household appliance. In this type of work, it is necessary to take into account the initial conditions of the property that are going to be modified and, in the event of any type of incident occurring a posteriori, the verification of whether or not it has necessarily been caused by the renovation work carried out.

In any case, both the Law for the Defence of Consumers and Users 1/2007 and the LOE (Law for the Regulation of Building 38/1999) and the Civil Code detail the guarantees that are observed when renovating a home:

En la prestación de servicios, señala 6 meses de plazo máximo para la reclamación de un vicio oculto.

En caso de llevarse a cabo cambios sustanciales en la construcción inicial, una reforma de la estructura o una obra de nueva planta, se respetarán los mismos plazos que si fuera una nueva edificación:

  • 1 año: para los defectos detectados en terminaciones y acabados como pintura, alicatado o revestimiento de la vivienda.
  • 3 años: para los defectos que impidan o dificulten la habitabilidad de dicha vivienda (humedades y falta de aislamiento acústico o térmico)
  • 10 años: para aquellos otros defectos que afecten a la estructura del edificio comprometiendo su estabilidad.

Para poder exigir la responsabilidad de los agentes de la construcción implicados, se dispone de un plazo máximo de 2 años desde que se descubra el vicio o defecto constructivo.

En caso de que la reforma no haya cumplido las especificaciones del proyecto o exista incumplimiento contractual, el plazo establecido para poder reclamar es de 5 por no haber cumplido el contrato.
